Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Stephen Chittenden dba ThrillGauge™ (“ThrillGauge,” “we,” “us,” or “our”). By creating an account, accessing the beta, or using ThrillGauge, you agree to these Terms and the Privacy Policy. If you do not agree, do not use ThrillGauge.

1. Eligibility

You must be at least 18 years old and legally able to enter this agreement. The beta is not intended for children.

2. RideFit estimates are not guarantees

RideFit Scores, classifications, ranges, confidence levels, restraint information, test-seat notes, and other results are estimates based partly on crowdsourced information. They are not medical advice, safety determinations, promises that a restraint will fit, or permission to ride.

3. Accounts and security

Provide accurate account information, protect your password, and notify us promptly of suspected unauthorized access. You may not sell or share accounts, access another user’s account, scrape the service, disrupt its operation, probe its security, or use automation without written permission. We may limit, suspend, or terminate access to protect users, data integrity, the service, or legal rights, or for violations of these Terms or the Community Guidelines.

4. Measurements, reports, and ratings

You are responsible for entering measurements carefully and submitting ride reports and ratings honestly. Validation can identify some mistakes but cannot verify accuracy. Do not fabricate outcomes, manipulate measurements, coordinate submissions, or create duplicate accounts to influence RideFit Scores, ratings, points, badges, rankings, or access. ThrillGauge may validate, weight, aggregate, exclude, or de-identify submissions.

5. Community features

Public usernames, ratings, points, badges, and rankings are governed by the Community Guidelines. You grant ThrillGauge a nonexclusive, worldwide, royalty-free license to host, process, reproduce, and display content you intentionally make public solely to operate, moderate, promote, and improve ThrillGauge. You retain any rights you otherwise hold. Do not submit material that violates another person’s rights.

6. Beta and ThrillGauge Plus

The service is under development. Features, scoring methods, data, availability, and access may change, contain errors, or be discontinued. Beta users may receive Plus without payment. Activating free beta access does not create an automatic subscription. Any future paid purchase will disclose its price, duration, renewal terms, included features, and cancellation method before authorization.

Shared Park Plan links may be viewed by anyone possessing the link until it expires after 14 days or the sender deactivates it. Do not share notes you are unwilling to disclose to every link recipient. Saving, importing, editing, reminders, and other designated planning features may require Plus. Walking estimates and reminder delivery are conveniences and are not guaranteed.

7. Privacy

Our Privacy Policy describes how information is collected, used, disclosed, retained, and deleted. Community profiles do not display exact measurements, individual ride reports, report dates, legal names, or email addresses.

8. Intellectual property and third-party marks

ThrillGauge’s name, logo, software, graphics, scoring presentation, and original content belong to Stephen Chittenden dba ThrillGauge™ or its licensors. Theme-park, resort, attraction, ride, and third-party names and marks belong to their respective owners. ThrillGauge is independent and is not affiliated with, endorsed by, or sponsored by any theme park, resort, operator, or ride manufacturer.

9. Availability and disclaimers

To the extent permitted by law, ThrillGauge is provided “as is” and “as available.” We do not warrant uninterrupted operation, complete or current data, or that an estimate will match a particular ride vehicle, seat, restraint, operator, or visit. Some jurisdictions do not permit certain disclaimers.

10. Limitation of liability

To the maximum extent permitted by law, Stephen Chittenden dba ThrillGauge™ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data; or losses arising from reliance on an estimate. Nothing in these Terms excludes rights or liability that cannot legally be excluded.

11. Ending use and account deletion

You may stop using ThrillGauge and delete your account through the app. The Privacy Policy explains what deletion removes and when limited de-identified ride evidence may be retained.

12. Changes

We may revise these Terms as ThrillGauge evolves. We will change the effective date and provide additional notice or request renewed agreement when appropriate.
